Welcome to the FLEX - MY Fitness Platform mobile application (the "App"). Please read these Terms of Use ("Terms") carefully. They contain the legal terms and conditions that you agree to when you use the service provided to you by Thrive AI & Tech Sdn Bhd, including information, text, images, graphics, data or other materials ("Content") and the user interfaces, software, functions, and any other services provided (the "Services").
By accessing and/or using the App, you agree to be bound by these Terms, whether you are a "Visitor" (which means that you simply browse the App) or you are a "Member" (which means that you have registered with the App). If you do not agree to these Terms, do not use our Services.
To access the App's Services, you are required to register by providing a valid phone number (via OTP verification) or by signing in through Google or Apple. You agree to provide accurate and complete registration information and to keep this information up to date.
Your use of the App is subject to our Privacy Policy, which we may amend from time to time. Please carefully review our Privacy Policy. By using the App, you consent to the collection, use, and sharing of your information as described in the Privacy Policy.
All intellectual property rights in the App, the Services, and the Content (other than content provided by users) are owned by Thrive AI & Tech Sdn Bhd or its licensors. You may not copy, modify, distribute, sell, or lease any part of our Services or included software, nor may you reverse engineer or attempt to extract the source code of that software.
Some of our Services are billed on a subscription basis ("Subscription(s)"). Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Payments will be charged to your Apple App Store or Google Play Store account at confirmation of purchase. Your account will be charged for renewal within 24 hours prior to the end of the current period. Subscriptions may be managed by the user and auto-renewal may be turned off by going to the user's device Account Settings after purchase.
The App offers a free tier with limited functionality. Free-tier users are subject to daily usage limits, which may include but are not limited to:
These limits may be adjusted from time to time at our discretion. Upgrading to a paid subscription removes these limits and provides access to additional features. We reserve the right to modify, suspend, or discontinue any free-tier features at any time without prior notice.
The AI Fitness Coach ("Nova") is powered by artificial intelligence and provides general fitness and nutrition guidance based on the information you provide. You acknowledge and agree that:
The App includes a points-based gamification system. Points may be earned through qualifying activities such as food logging, step tracking, workout completion, Instagram sharing, and other activities as determined by us. You acknowledge and agree that:
By submitting food photos, chat messages, or other content through the App, you grant Thrive AI & Tech Sdn Bhd a non-exclusive, worldwide, royalty-free licence to use, process, and store such content for the purposes of providing and improving the Services. Food photos from successful scans are processed by third-party AI services for nutritional analysis and are not stored on our servers after analysis is complete. However, if you submit a missing food report, the associated food photo may be retained on our servers for the purpose of reviewing the report and adding the item to our nutrition database.
You are solely responsible for the content you submit. You agree not to submit content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable.
The App provides workout programs, exercise demonstrations, and fitness content for informational purposes. You acknowledge and agree that:
FLEX - MY Fitness Platform is not a medical application and does not provide medical advice, diagnoses, or treatment plans. All features, including calorie tracking, macro tracking, TDEE calculation, AI food scanning, AI fitness coaching, workout programs, and goal setting, are for informational and self-educational purposes only.
By using this App, you acknowledge that you are solely responsible for the dietary, fitness, and health decisions you make. The App generates recommendations based on the data you voluntarily enter (such as weight, height, age, goals, and activity level), but it does not take into account medical conditions, personal health history, or unique nutritional needs.
We strongly recommend consulting with your physician, nutritionist, or other qualified healthcare provider before starting any diet, fitness program, or weight loss plan.
By continuing to use the App, you agree that Thrive AI & Tech Sdn Bhd is not liable for any health issues, injuries, or consequences resulting from the use of FLEX or decisions you make based on its content or features. All use is at your own risk.
The App integrates with third-party services including but not limited to Apple Health, Health Connect, and Instagram. Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or content of third-party services.
Instagram sharing features require you to have an active Instagram account. We are not responsible for any changes to Instagram's platform, policies, or APIs that may affect the functionality of the sharing feature.
We may modify these Terms from time to time. When we do, we will post the modification within the App or otherwise provide you with notice of the modification. Your continued use of the App after the effective date of any modification constitutes your acceptance of the modified Terms.
We reserve the right to terminate or restrict your use of our Services, without notice, for any or no reason whatsoever. Upon termination, your right to use the App will immediately cease, and any accumulated points will be forfeited.
You may terminate your account at any time by deleting your account through the App's settings or by contacting us at myprojectfit@gmail.com.
To the maximum extent permitted by applicable law, Thrive AI & Tech Sdn Bhd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the App or Services.
These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law principles.
